New York woman hit by taxi after being thrown from motorcycle

Motorcycles possess few safety features relative to other motor vehicles. This lack of protection exposes riders to a greater risk of serious injury if they are involved in a motor vehicle accident. This heightened risk of injury can lead to significant damages.

A New York woman was recently thrown from a motorcycle into oncoming traffic. She was riding on the back of a motorcycle when the driver lost control and collided with the median, ejecting the woman into the opposite lane. She was then hit by a taxi traveling in that direction, which fled the scene of the accident.

The woman was taken to a nearby hospital, but died as a result of her injuries. Authorities do not intend to charge the driver of the motorcycle, but are still looking for the driver of the taxi.

Motorcycle accidents are governed by the same rules as those involving other vehicles. Liability for any injuries or other damages is based on the assessment of which party was negligent, if any. To hold a defendant liable for negligence, a victim must show that they owed a duty of reasonable care that was breached, that the breach caused their injuries and that the injuries resulted in damages. Should they prevail in a negligence suit, victims of motorcycle accidents may be able to recover for hospital bills, rehabilitation expenses, lost wages and pain and suffering.

It is important for all drivers to be aware of the presence of motorcycles and to use care in their actions when in the same area. An exhilarating ride on a motorcycle can be cut tragically short should a motorcyclist or passenger fall victim to an auto accident caused by another driver’s negligence. But through a negligence lawsuit, these victims or their loved ones can seek the financial resources needed to recover from the incident.
