All roadways can present unsafe conditions for drivers, passengers and pedestrians. This risk is heightened when a driver is failing to meet the proper level of care to ensure the safety of others by driving while preoccupied, failing to regard weather conditions or disregarding traffic signs, among other actions. It is therefore important that all drivers act properly and apply the proper level of care to prevent injuries to others to the fullest extent possible.

A car accident recently occurred in New York City involving two taxicabs. The collision caused one of the cabs to propel onto a nearby sidewalk, striking a pedestrian and a pole. One of the cabs reportedly ran a red light, resulting in the collision. The pedestrian was standing on the sidewalk with his family, but they were not injured in the accident. The pedestrian and one of the drivers were both taken to nearby hospitals for treatment of their injuries.

For auto accidents involving motor vehicles and pedestrians, the liability for any resulting injuries hinges on the determination of which party was negligent. Victims injured in such an accident must show that a defendant owed them a duty of care, failed to meet that duty, the failure caused the accident and the victim was injured as a result. There are many actions that may evidence negligence on the part of a driver including driving while intoxicated, speeding and failing to follow traffic signals.

In the accident in this case, one of the cab drivers reportedly ran a red light. This failure to follow the stoplight likely resulted in the collision between the two taxis, causing one of them to launch onto a sidewalk and injuring the pedestrian. Regardless of which cab struck the pedestrian, the driver that ran the red light was likely negligent in this case and would be liable for the injuries to the pedestrian.
