The road can be a dangerous place sometimes, especially if a driver is not giving their full attention to operating their vehicle. One of the more recent forms of distracted driving, texting while driving, creates unnecessarily dangerous conditions for others that could be prevented.

A New Jersey woman is facing criminal charges stemming from a car accident in which she was allegedly texting on her phone. She was driving on Routes 1 and 9 in Newark when she switched lanes and struck a pickup. The pickup overturned as a result of the collision, ejecting the driver and killing him at the scene. In addition to having a suspended license, authorities are alleging that the female driver was also texting at the time of the accident. She is the first person in her county to be charged with homicide related to a texting while driving accident.

Drivers of motor vehicles are required to apply reasonable care under the circumstances in their actions. A failure to do so may indicate negligence on their part and expose them to liability for any injuries caused in a resulting accident. If someone is injured in an accident, they may bring an action against the party they believe to be at fault. To be successful in such an action, the injured victim must show that the defendant owed them a duty of care as outlined above, breached that duty, the breach caused an accident and the victim was injured as a result.
