A New Jersey woman is facing criminal charges stemming from a car accident in which she was allegedly texting on her phone. She was driving on Routes 1 and 9 in Newark when she switched lanes and struck a pickup. The pickup overturned as a result of the collision, ejecting the driver and killing him at the scene. In addition to having a suspended license, authorities are alleging that the female driver was also texting at the time of the accident. She is the first person in her county to be charged with homicide related to a texting while driving accident.

A failure to do so may indicate negligence on their part and expose them to liability for any injuries caused in a resulting accident. If someone is injured in an accident, they may bring an action against the party they believe to be at fault. To be successful in such an action, the injured victim must show that the defendant owed them a duty of care as outlined above, breached that duty, the breach caused an accident and the victim was injured as a result. There are many actions that a driver can engage in that may show that they were negligent in causing an accident including improper lane changing, disregarding traffic conditions and distracted driving.

There are many actions that may lead to an auto accident, which is why it is imperative that drivers act reasonably. Failing to do so may expose them to liability for any damages that result.
